Staff Analysis of the Legislation

SB 204 amends Code section 5-6-43 of the OCGA. It states that within 30 days of filing the notice of appeal, the clerk of trial court should prepare a complete copy of the entire record with a copy of the notice of appeal, date of filing, and transcript of evidence. Exceptions for extensions of time allow the clerk to notify the judge, appellant, and appellee in writing three days if for good cause the clerk is unable to transmit the filing within 30 days. When the judge receives written notification, he or she shall issue an order establishing schedule for the transmittal of the record and transcript. Failure to meet these deadlines will be issued as contempt of court.
